Protection of databases, cultural heritage and digital single market

Abstract

This paper focuses on the European legal protection of databases and addresses its evolution with particular reference to the theme of the preservation of cultural heritage. The intersection between technological development, digital market and cultural heritage has led the European legislator to introduce, through the directive (EU) 2019/790, new exceptions to the protection regime of databases, with results that do not appear to be entirely satisfactory.
