Abstract

In examining the Court of Justice Opinion 2/14 the A. underlines the key role that plays in the system of the European Convention on Human Rights the external control by the European Court of Human Rights. The A. suggests that the Court of Justice reasoning tends to maintain the EU and its institutions out of reach of such a control. In so doing the Court of Justice makes it difficult if not impossible the EU accession to the European Convention (article 6, para. 2, TEU).
