Abstract

Defined the concepts of punishment, punitive sanction and restoration, as well as their mutual relationships, the analysis will focus on the gradual implementation, in the Italian Legal System, of restorative justice as a radical alternative to traditional criminal justice and its shortcomings. "De lege ferenda", it appears that this process will take a long time to complete, but also that the coexistence between punitive and restorative paradigm has to be preserved.
