Abstract
This essay examines the many problems connected with the task of reforming civil procedural laws in France and in Italy. It highlights the importance of an adaptable structure of the preliminary stage ("pre-trial") where the judge’s role is reinforced ("case management") and the cooperation between the parties is encouraged. The reforming processes are considered according to the background cultures upon which the reforms are elaborated.
