Abstract

The right to conscientious objection is today strongly criticized. The article firstly reaffirms its constitutional foundation and value, and subsequently deals with the main arguments standing against the recognition of this right. Then it offers some conclusive remarks concerning the impossibility of its a priori denial, as well as the necessity to rather balance it against other values of the same rank, in order to grant them all the best implementation in every single case.
