Abstract
The author states that the common finalization of protection of health and environment collides with the guarantee constraints of criminal law that properly request a clear distinction between spheres and matrices of risk. In front of the massive use of repressive instrument notes, in light of case law, a not always high degree of effectiveness of the protection. Therefore more attention could be deserve also to mechanisms known in other juridical experiences, with fewer limits in constitutional terms
