Abstract

The objective of this essay is to reconstruct the limitations of the individual autonomy in the matter of s. c. "lavoro a progetto" (articles 61- 69, Act n. 276/2003). First, the author deals with the problems of the binding nature of the legal provisions and the (relative) non-waivability of the rights relating to the mandatory rules, then he turns his attention to the doctrinal debate about the "assisted will" of the "project workers". In particular, the study focuses upon the interpretation of art. 68: in the author opinion, with the assistance of the Certifiers (articles 75-81, Act n. 276/2003), employers and project workers can exclude, by way an individual agreement, the application of some protective rules provided by the same piece of legislation.
