Abstract

The author identifies the complex trajectories, traced by the equality either inside the employment contract or inside and out the borders of the enterprise, arriving to touch the open spaces of the market. Inside the contract there is in action the antagonist couple, made by equality/ autonomy: the former acts, against the contract freedom, like a limit to the private autonomy. Within the borders of the enterprise the equality acts like a limit (not internal) to the employers' powers, which must be exercised according to the personal dignity and without breaching the not discrimination principle. In the market, the equality shows - in the maximum intensity - its universalistic vocation and has a disposition to bypass the contractual dimension, moving to the plan of the social citizenship rights.
