Abstract
The analysis of one of the crucial questions of constitutional law - the definition of the reciprocal borderlines of the European and national jurisdictions - is faced by the Author through the lenses of the complex relationship between the Federal Constitutional Court and the European Court of Justice. The exam of the case law on this issue shows how in the present situation the question of principle is still unsolved. Besides, the evaluation in political terms underlines that the national courts main concern are the fundamental individual rights rather than the economic policy issues.
