Abstract

According to the Author the notion "protection and safety at work" contained in the proposed new art. 117 of the Italian Constitution must be interpreted in the sense of administrative activity geared to workers protection; the Author underlines the risks of different readings. On this premise, he analyses the question of the decentralisation of the employment policies: he stresses the opportunity of abandoning a centralised system, which has the tendency to deny the local specificities; on the other hand, it is necessary to adopt the horizontal subsidiary principle in order to face the risks to disaggregate the system as a whole.
