Abstract
The Public Contracts Code regulations concerning social clauses of fair treatment attribute a key role to collective agreements in the fight against wage dumping. However, the collective agreement's legal status, lacking the "erga omnes" effectiveness, results in a weakness in respect of both the definition of the actual guaranteed wage and the compatibility of the clauses with European Union legislation.
