Abstract
In the last period there have been developments in relation to the topic of incidental issues of constitutional legitimacy raised in the course of verification lawsuits. In the judgments 48/2021 and 240/2021, the Constitutional Court admitted such “abstractµ issues not due to the unavailability of another judicial remedy but due to the unavailability of another effective and timely judicial remedy. This innovation could herald a progressive abandonment of the requirement of the free zone: the incidental question should be admitted even if it arises in a verification judgment validly established in order to defend a life asset from an actual or probable harm deriving from a law.
