Abstract

The paper is based on a substantial writing by Andrea Morrone, attempting to open a dialogue on the topics addressed. The main theme concern the recentralization of competences in favor of the State and a substantial review of the reform that occurred in 2001. Morrone believes that the main instrument of recentralization can be subsidiarity principle, while also identifying other mechanism (transversal subjects and the fundamental subjects principles). Nevertheless, the subsidiarity principle, in decentralized contexts, is mainly a way for the allocation of competences, pursuant to art. 118 of the Constitution, and only exceptionally a recentralization clause
