Abstract
The essay aims at analysing the regional measures adopted by Region Emilia-Romagna in order to face the health emergency related to the Covid-19. Pandemic emergency represents an unprecedent challenge for the Institutions faced with the balance between the need to contain the spread of the virus and the guarantee of citizens’ fundamental rights. In the current state of affairs, the legal framework appears uncoherent and poorly intelligible with reference to the great number of acts adopted at national, regional and local level. In this sense, the essay intends to underline the impact of the emergency approach on the Italian legal system, with specific regard to the system of legal sources. On the other hand, it is worth noting that Region Emilia-Romagna has successfully passed the stress test represented by the health emergency, adopting effective measures to contain the health emergency, in accordance with the constitutional principles of subsidiarity and proximity.
