Abstract
The work analyses, in the first part, the limits and the presuppositions of the power of the Regions and Municipalities to issue urgent and necessity ordinances, during the health emergency resulting from the COVID-19 pandemic. Finally, the last part of the work is dedicated to the study of the legitimacy of the regional and municipal acts issued. Subsequently, the study focuses on the exercise of these powers carried out by the President of the Tuscany Region and by the Mayors of the major Tuscan Municipalities.
