Abstract

This article analyzes the question of participation in rulemaking in international law and in EU law. With regard to European law, the right to participation in rulemaking is expressly envisaged in some sectors. The most important examples of these sectoral rules will be outlined. Then, the article will focus on the question as to whether a right to participation in rulemaking exists where it is not expressly and formally envisaged. With regard to international law, the article analyzes the mechanisms for participation in the regulatory activities of supranational and global authorities.
