Abstract

The essay concerns the regulation of that form of remote working called lavoro agile, agile work, in Italian legislation and focuses on some peculiarities of employer’s powers. It starts by a critical exposition of the current debate about Act n. 81/2017 and its possible reformation after the pandemic emergency. Then the a. draws a map of powers in the agile work, starting by analysing the role of the individual agreement which regulates, according to Act 81, the agile part of employment relationship. The suggested hypothesis is that employer’s powers are transformed and differently distributed rather than attenuated, with a real risk of weakening labour protection, in spite of the larger space-time freedom enjoyed by the agile worker.
