Abstract
The author, considering the most recent evolution of labour law in a comparative and European scenario, draws the sketch of a present situation of crisis, stressing the fact that while "capital is multi- and trans-national [...] despite the right of individual workers to circulate, collectively labour retains largely national forms". New capitalism demands therefore new labour to establish new relations in an European and global economy.
