Abstract
After a brief recall of a particular hypothesis of interference between family and labour law in the previous legislation the author analyses the relation between worker's absence and the theory of interruption of labour relation. The opportunity to rethink the labour theorisation about the impossibility of developing labour performance is offered by the endorsement of law n. 53/2000 on parental leaves.
