Abstract

The essay deals with the third term limit envisaged by law no. 165/2004 («Provisions for the implementation of article 122, first paragraph, of the Constitution») for regional elected Presidents. The Author examines its function as an instrument to counterbalance political power which is concentrated in the elected Presidents. The third term limit is also examined in relation to the violations that could occur during the next regional elections, as some outgoing Presidents invoke the non-immediately applicative nature of the provision which provides for it. The essay proposes possible solutions and hopes for an intervention by the Constitutional Court aimed at reaffirming the constitutional nature of the third term limit and its immediate effectiveness in the regional system
